Wanted to buy my own modem.

We have a double play (internet deluxe and 2 lines of voice) and we wanted to get rid of the $12.85 equipment charge to save some money. Right now we have 2 separate equipment which are the SMC that they said for the internet and the Arris TM822 I belive for the Voice lines. I was told by Comcast Service representative that I cannot combine both in one equipment that they use in the residential tripple play which is the Arris SG862G. The first representative says we can replace the SMC modem with the Arris SB6141 and leave the Arris TM822 and they will remove the $12.95 equipment fee because the Arris TM822 comes free with the voicelines. Then to make sure before I buy a modem I called again and the Comcast Service representative I spoke to says the Arris TM822 is free because we are already paying for the SMC and they do no want to double charge us. But if we will replace the SMC with our own cable modem then Comcast will start charging us on the Arris TM822 voice equipment. These 2  statements from Comcast representatives were conflicting and confusing. Any one from Comcast who knows better that can assist me here? Thanks in advance.
